We have many years of experience in the enforcement of Austrian and German judgments in Slovakia. We will need an enforcement title from you before filing a petition for enforcement.
The enforcement title for the purposes of Slovak enforcement proceedings is:
European order for payment procedure
In the event of a cross-border dispute, we will represent you in applying for a European order for payment procedure – Form A in conjunction with a declaration of enforceability – Form G in the Slovak language. If the European order for payment and the declaration of enforceability are served in German, an official translation into Slovak will be necessary. The European order for a valid order procedure was introduced by Regulation (EC) No 1896/2006 of the European Parliament and of the Council of 12 December 2006.
Judgment
In the event of a cross-border dispute, we will represent you in the application of an Austrian judgment or a German judgment in Slovak enforcement proceedings. If the Judgment is delivered in the German language, an official translation into Slovak will be necessary.
We will then arrange for the issuance of a European Enforcement Title Certificate for the purpose of filing a petition for enforcement.
Decision in civil and commercial matters in cross-border disputes whose value does not exceed EUR 2000,-
The European Small Claims Procedure is governed by the procedural law of the Member State in which the proceedings are conducted. A judgment given in a Member State in a European Small Claims Procedure shall be recognised and enforced in another Member State without the need for an exequatur and without any possibility of opposing its recognition. At the request of a party, the court or tribunal shall, at no additional cost, issue a certificate of the judgment given in the European Small Claims Procedure using model form D.
Foreign writ of execution enforceable in the Slovak Republic

If it is proposed to execute the execution on the basis of a foreign execution title and it is not a case under Section 53(2) of the Execution Procedure Code, the court shall, before issuing a mandate for execution, deliver the foreign execution title to the person who is named as the obligor in the petition for execution and shall instruct him/her on the possibility of objecting to the grounds for non-recognition pursuant to a special regulation.
The arbitral award shall be enforceable in the Slovak Republic pursuant to the Convention on the Recognition and Enforcement of Foreign Judgments in Civil or Commercial Matters and the Act on Private International Law and Procedure.
